The Narrandera Shire Council has granted conditional consent to a development application for a three lot Torrens Title subdivision of Lot 74 in DP 1278531 Driscoll Road Narrandera.

The Council resolved last year to create and sell two new lots in the Red Hill Industrial Estate for potential new industrial developments.

A DA was submitted to the recent March meeting seeking Council approval for the subdivision.

Two submissions were received at the completion of the community notification period, with one objecting to the proposed subdivision.

Where submissions objecting to a development are received, the application is required to be presented to Council for consideration and determination.

One of the submission writers felt the subdivision was creating a ‘superlot’ that might likely be divided in future. The objector felt that the truck wash and dam on part of lot 77 should be subdivided onto a separate lot.

“Council should have an outline development plan for Lot 77 and not just be developing stages on an ad hoc approach. Would Council allow a private developer to take this approach – highly unlikely,” the letter read.

The writer also felt the retarding basin/drain should be security-fenced at Council’s expense to prevent unauthorised access.

“In its present state it is a hazard to the public. Once again a private developer could be likely to be made to do so – so why not the Council!

“It is unacceptable that at times of high rainfall the retarding basin breaches its capacity and leads to partial inundation of our property. What studies have ben done to ascertain the basin is an appropriate size to contain storm water when Lot 77 is fully developed and storm water is running off future industrial rooftops?”

The writer sought an onsite meeting with Council.

The other submission had no objection to the development provided Council had the appropriate drainage for storm or flood water in place.

“The concern we have is that our premises may be inundated with storm or flood water from the development as Lott 77 was on a natural watercourse which if heavy rain fell his/her premises could be left open to flooding as it was at the lowest end of the estate.”

The submission writer threatened to take legal action if this occurred.

In relation to these submissions the Council pointed out that the subdivision involves the creation of two new lots at the western end of the Red Hill Industrial Estate and wuld not therefore affect the truck wash and dam.

It also pointed out that the creation of two new lots at the western end of Red Hill Industrial area would not affect stormwater on the eastern side of Red Hill and that any impacts of any future development of the eastern part of Lot 77 would be assessed at that time.

“Council has completed drainage and stormwater works at the Red Hill Industrial Estate, such as a retention basin on Lot 74, diversion drains, kerb and guttering along Driscoll Road.

“The subdivision of proposed lots 75 and 76 will not increase stormwater runoff from Lot 77,” the Council stated.

Items contained within the submissions were noted by Council and were considered separately to the development application, as they were considered to be related to Council land management rather than the subdivision of the land in question.
